There are many reasons to put off drafting or updating a will and preparing an estate plan, including the mental challenge of facing the inevitable and the financial cost and time required. However, to not do so puts the burden on the people that you love at a time when you likely would prefer them to have as little weight put upon them as possible. By setting your plan out in a will, your loved ones are spared from the complexity of the process required to make them administrators of your estate. Further, your property will not be distributed according to the default rules (which may not be consistent with the manner that you would have distributed your property) which are set out in legislation.

The practice’s low overhead allows it to service clients in non-traditional manners, including house-calls for those that can’t or would prefer not to come to the practice’s facilities.

If you are concerned that the will kit you purchased may not adequately reflect your intentions, I would be pleased to review it with you. You may not be aware of all to the pros and cons of using a will kit.

Your wishes are what is most important, and your will should reflect them. There are, however, options available to you to include provisions in your will that embody your wishes in a tax-efficient form. Testamentary trusts (including trusts settled using insurance proceeds) for the benefit of your spouse or for your children are examples of such provisions. The tax savings enjoyed by the beneficiaries of such trusts often significantly outweigh the additional expense required to set them up.
